Repair Services-Limited Warranty
Limited Warranty. The limited warranty covers only those products that are owned by the individual requesting repair services (“Owner”) and sent to SRC Technologies Group, Inc. (“SRCT”) for the purpose of SRCT performing repair services (the “Repaired Product”). SRCT warrants that any Repaired Product repaired by SRCT will be free from defects in workmanship under normal use and service for ninety (90) days from the date the Repaired Product is shipped by SRCT to Owner.
Remedies. SRCT’s obligation to Owner for breach of SRCT’s Limited Warranty with respect to any Repaired Product is limited, at SRCT’s option, to attempting to repair the Repaired Product a second time, replacement of the Repaired Product with a similar product, or refunding the fees Purchaser paid to SRCT for services related to the Repaired Product, less any shipping expenses incurred by SRCT related to the Repaired Product. SRCT shall not be liable for the loss of use of any Repaired Product, loss of time, inconvenience, commercial loss or any other direct, indirect consequential, special or incidental damages due to breach of the above warranty or any other failure to comply with the terms of the contract between SRCT and the Owner. The warranty coverage amount is strictly limited to the original selling price of repair services on the Repaired Product.
Disclaimer. SRCT’s LIMITED WARRANTY FOR THE REPAIRED PRODUCT IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Exclusions. SRCT’s Limited Warranty is subject to, and qualified by, the warranty administration provisions set forth herein and by the following exclusions:
With respect to parts and materials manufactured by others and incorporated by SRCT into the Repaired Product, such parts and materials shall be covered only by the warranty, if any, of the manufacturer thereof, and SRCT shall assign to Owner any such warranty to the extent assignable by SRCT, and upon Owner’s request, shall cooperate with Owner, at Owner’s expense, to seek to enforce such warranties on Owner’s behalf. SRCT shall not provide any other relief and provides no warranty with respect to such parts and materials.
The following are not covered by SRCT’s Limited Warranty:
Failure of the Repaired Product caused by:
incorrect installation or adjustment following shipment by SRCT;
improper use, abuse, or negligence following shipment by SRCT;
improper storage or handling of Repaired Product subsequent to shipment by SRCT and prior to installation;
accident or act of God;
normal wear and tear;
the use of unauthorized accessories or parts;
improper or unauthorized repairs or services;
a pre-existing condition of the equipment into which Repaired Product is installed; or
unauthorized modification of Repaired Product (or the equipment into which Repaired Product is installed) that alters its form, fit, or function.
Progressive damages.
SRCT’s Limited Warranty shall be void and of no force and effect if repairs made by Owner to Repaired Product are (1) not made in conformity with the applicable original manufacturer specifications or (2) are made without the express written approval of SRCT.
The following are not covered by SRCT’s Limited Warranty: (a) costs incurred by Owner for the removal and/or reinstallation of the Repaired Product, (b) injury to any person or property or death of any person, (c) payment to any third-party for services not agreed to in writing by SRCT prior to the engagement or use of such services and (d) travel time, mileage, meals, tolls, lodging and other travel expenses.
The following warranty administration provisions shall apply to any alleged breach of SRCT’s Limited Warranty made by Purchaser to SRCT related to SRCT’s repair of Purchaser’s Product:
Claim Information. For a warranty claim to be valid, the Purchaser must call SRCT at 1-800-634-2858 within ninety (90) days of the date SRCT initially shipped the repaired Product to Purchaser to submit a warranty claim.
SRCT’s Limited Warranty Claim Processing. SRCT’s Limited Warranty claims shall be processed by SRCT within thirty (30) business days of receipt. Within such time period SRCT shall inform Owner whether Owner’s warranty claim is valid or denied. SRCT shall, in its sole discretion, determine if a warranty claim is valid or denied.
Shipping/Handling. Owner shall be responsible for the cost to return the failed Repaired Product to SRCT. If SRCT approves the warranty claim, then SRCT will be responsible for the cost to ship the Repaired Product back to Owner or ship the replacement product back to the Owner (at SRCT’s option). If SRCT rejects the warranty claim, then Owner shall be responsible for the cost to return the Repaired Product to Owner.
Disposition of Returned Product. For all warranty claims, if SRCT successfully repairs the Repaired Product, SRCT will return the Repaired Product. If SRCT chooses to provide a replacement product, the returned Repaired Product becomes the property of SRCT.
SRCT Branded Products-Limited Warranty
Limited Warranty. The limited warranty covers only those SRCT brand products purchased from the SRCT website (“Branded Products”) and extends only to the Original Purchaser. The “Original Purchaser” in the person or entity making the purchase from the SRCT website; it does not include any subsequent owners, purchasers or transferees. SRCT warrants that any Branded Product sold by SRCT will be free from defects in materials and workmanship under normal use for one (1) year from the date the Branded Product is shipped by SRCT to Original Purchaser.
Remedies. SRCT’s obligation to Original Purchaser with respect to any Branded Product for breach of SRCT’s Limited Warranty is limited, at SRCT’s option, to repairing or replacing the Branded Product. SRCT shall not be liable for the loss of use of any Branded Product, loss of time, inconvenience, commercial loss or any other direct, indirect consequential, special or incidental damages due to breach of the above warranty or any other failure to comply with the terms of the contract between SRCT and the Original Purchaser. Warranty coverage is strictly limited to the original selling price of the Branded Product, as applicable.

Within such time period SRCT shall inform Original Purchaser whether Original Purchaser’s warranty claim is valid or denied. Shipping/Handling. Original Purchaser shall be responsible for the cost to return the failed Branded Product to SRCT. If SRCT approves the warranty claim, then SRCT will be responsible for the cost to ship the repaired Branded Product back to Original Purchaser or ship the replacement product back to the Original Purchaser (at SRCT’s option). If SRCT rejects the warranty claim, then Original Purchaser shall be responsible for the cost to return the Branded Product to Original Purchaser.

Non-SRCT Branded Products – No Warranty
Any product sold on the SRCT website that is not a SRCT Branded Product ( “Non-SRCT Branded Products”) will be sold AS IS. If such Non-SRCT Branded Products have warranties under the brand from which they are sold, the terms and conditions of such warranty will govern whether and/or how the warranty passes through to the purchaser.
SRCT DOES NOT PROVIDE ANY WARRANTY FOR NON-SRCT BRANDED PRODUCTS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
